Cutting The Bloat

Aadhaar was unwieldy and growing dangerously. SC restricts it to welfare schemes

Aadhaar’s untrammelled run over the Indian people has come to an end with the Supreme Court cutting it down to size on Wednesday. The majority verdict has ruled that it is illegal for telecom companies, banks and other commercial entities to demand Aadhaar for service delivery and restricts governmental use of Aadhaar for only those purposes that are backed by laws. So the identification and authentication of beneficiaries of PDS and direct benefit transfer schemes – the original purpose of Aadhaar – passes muster but not the “function creep” that mandated Aadhaar for students appearing in examinations and dozens of other activities, and moved it from being an enabling tool to an exclusionary tool.

Government’s desire to curb tax evasion by enacting Section 139AA of Income Tax Act linking PAN cards to Aadhaar for filing tax returns aces the test. But not the draconian threat to suspend bank accounts not linked to Aadhaar for tackling money laundering, a lazy excuse given that modern data analytics tools can easily flag suspicious high value transactions. In short, the judgment gives ample indication that Supreme Court expects any future use of Aadhaar must satisfy the proportionality principle, where restrictive means employed to further legitimate state interest must seek out equally effective alter-natives and invade individual rights only to the minimum degree necessary.

This is in stark contrast to Aadhaar’s overarching use and government denial over exclusion errors. No technology is perfect and this is why purpose limitation makes sense, to forestall a surveillance state and to preempt massive system failures. Passing a data protection law cannot wait any longer. It would be instructive for everyone, especially the government, to read Justice DY Chandrachud’s stinging dissent that exposes the Aadhaar system’s design flaws, the Aadhaar Act’s flawed structuring of UIDAI, and the bypassing of Rajya Sabha scrutiny in taking the money bill route.

He notes with concern that Aadhaar Act fails the test of reason-ableness as it tasks UIDAI with all administrative, adjudicatory, investigative, monitoring, and grievance redressal functions – clearly a weak regulatory mechanism for handling confidential private information of a billion people. Justice Chandrachud also likens the superseding of Rajya Sabha to a “fraud on the Constitution”. NDA, for the hasty enactment of 2016, and UPA for allowing UIDAI to function five years without statutory backing, can make amends by collaborating on a better Aadhaar Act.

Aadhaar Swings The Other Way

Supreme Court should not have struck down its use as verification tool by private sector

That the Supreme Court has upheld the constitutional validity of Aadhaar is good. That it has greenlighted the use of Aadhaar for welfare payments disbursal is good. That it has maintained the PAN-Aadhaar-income tax filing link is good. But that the judgment may prevent private entities from using Aadhaar as a verification tool, thanks to the court’s reading down of Section 57 of the Aadhaar Act, is terrible. And the government must undo what the court has done in this regard.

There are two parts to this argument. First, disallowing Aadhaar as a verification tool in the private sector disempowers millions of aam aadmi as well as some economic migrants from better off classes. By implication, this court verdict is a blow against economic efficiency. Second, the privacy argument didn’t need prohibition of Aadhaar as a verification tool for the private sector. It needed better data safeguarding measures.

Let’s explain both.

India has always been a difficult country for Indians. The state always demanded layers of verification for even simple requirements citizens had. And rules were always ignorant of evolving economic realities. Address verification in particular assumed that everyone for generations stayed in one residence, where ration cards were issued for everyone, and there was, if you were lucky, a government telephone connection. That reality had long disappeared as Indian society and economy changed, as economic opportunities expanded. But the address proof requirement continued and imposed huge compliance burden on millions of Indians.

The poor are typically also document poor, and the system was stacked against them. And among better off Indians who moved cities in search of better jobs and shifted rented accommodation to maximise their utility in the rental market, address proof was also a burdensome requirement. All that changed when Aadhaar was championed by the Modi government as the one-stop identity/address proof for anyone who had got that unique number. So, a poor migrant working in Delhi or Mumbai could get a local SIM card by presenting his Aadhaar card and getting his thumbprint verified. He or she could open a bank account in new, nimble private banks like Kotak and Janalakshmi. Landlords, usually hostile to poor migrants, and employers, suspicious of them, had the assurance that a migrant with an Aadhaar-verified local SIM or a local bank account was who he or she claimed to be.

With the Supreme Court striking down the use of Aadhaar as a verification tool by the private sector, this extraordinary, socially progressive, economically efficient option is now gone. And that’s bad news not just for the poor migrant but also for the middle class young Indian who moves cities and residences to search for better white collar jobs. Plus, public sector banks were opening bank accounts for poor Indians by asking for the Aadhaar card and using thumbprint verification as a second step check. If even public sector banks stop using thumbprint verification, it’s another blow against the poor because banks were comforted by the second step check, especially when dealing with the migrant poor.

The court’s verdict also increases the cost of customer acquisition for many private sector service companies. Telecom companies could issue a SIM via a thumbprint check with the Aadhaar database. Now, they have to physically verify the address, like before, or they will demand supplementary documents. Same for private banks. The extra cost, when added up, can be huge and therefore seriously economically inefficient. Plus, the court’s verdict also puts a huge question mark on RBI’s KYC norms centred around Aadhaar. And if that creates a whole lot more complications, the extent of economic inefficiency will increase.

Indeed, as some experts are fearing, because the Supreme Court has come down hard on private sector using Aadhaar as a verification tool, the needle may swing back all the way and Aadhaar may not even be accepted by some private entities as an identity proof. If that happens, all outcomes will be even worse.

So, what should the court have done? This brings us to the second part of our argument. Concerns that private entities may hoard biometric data used for verification are valid. But that concern could have been addressed by asking for strict protocols on the use of Aadhaar in the private sector. For example, thumbprint readers could have been issued only by UIDAI, with proper safeguards built in. Also, UIDAI could have been asked by the court to frame additional safeguard protocols for use of Aadhaar by the private sector.

Verification by itself is not violation – that is what the court verdict seems to have missed. Think about it this way – now even if you want to, you cannot use Aadhaar as a tool for verifying who you are for any private sector service. The court should have kept Aadhaar verification in the private sector as a voluntary option, after asking for additional data safeguards. A faulty argument based on privacy has killed a huge individual and economic convenience.

Therefore, the Modi government must restore Aadhaar’s convenience attribute. It can amend relevant sectoral laws in, say, telecom and banking, allowing voluntary use of Aadhaar as a verification tool in the private sector. It can tailor the national data protection law to take care of this. Or it can think of filing a curative petition in the Supreme Court. Something, though, must be done. Aadhaar was a great empowering tool for aam aadmi in India’s growing private sector economy. Now, it’s anti-aam aadmi.

Confused Verdict, Calls for Revision

The majority view of the five-member bench of the Supreme Court on Aadhaar is confusing and itself confused. The verdict pronounces Aadhaar constitutionally valid for state schemes, invalidates linking of bank accounts and phone connections to Aadhaar, retains linking of Aadhaar to the income-tax Permanent Account Number (PAN), tightens protection for personal data somewhat and removes the monopoly the Aadhaar Act gave the Unique Identity Authority in the matter of prosecuting anyone for Aadhaar misuse.

A major setback is that nongovernment entities can no longer use Aadhaar-Based Biometric Authorisation (ABBA). This will disempower the poor, especially migrants, who have been using Aadhaar as a key document of identity. Both the majority view as well as the dissenting ruling by Justice D Y Chandrachud stress the need for India to have a strong data protection law. Ideally, the government should put in place a rigorous law to protect data and prevent its misuse, including data relating to and stemming from Aadhaar, and move a curative petition to remove the ban on private companies using ABBA.

Strangely, the majority view upholds Aadhaar on the ground that the ABBA process does not leak any data to the seeker of the authorisation; and then proceeds to declare that allowing private entities to access Aadhaar data would allow for wrongful commercialisation of biometric data. Ideally, Aadhaar should at least function like a passport: not mandated for everyone but capable of being used as proof of identity by any holder. Enabling voluntary submission of biometrics for ABBA is a task the government must take up.

It is unfortunate that the judges, save Justice Chandrachud, found no problem with treating the Aadhaar Bill as a money Bill to circumvent its passage in the Rajya Sabha. Any Bill can now be given a Consolidated Fund of India dimension and passed off as a money Bill. This would effectively destroy the bicameral system of Parliament. The reasoning of the dissenting ruling is entirely convincing. This, too, calls for review.

Fast-Track Courts for Political Criminals

The Supreme Court’s judgment on creeping criminalisation of politics is a balanced decision. It has made clear the limits of its authority, by correctly putting the onus of stemming the tide of criminalisation on Parliament and voters. Democracy does not function on the basis of rules and institutions alone. The primary requirement of democracy is an involved, vigilant citizenry. Their democratic consciousness and readiness to act determine the calibre of any democracy.

In a democracy, it is the electorate that has the final say through the ballot on who gets to represent them. The voter is the gatekeeper and can keep criminals out of public office. But, to be effective gatekeepers, the voter must have the requisite information. To this end, the court has ordered that affidavits filed by candidates must mandatorily provide clear information on criminal charges against them. This information must be widely publicised through media and the websites of political parties, enabling voters to make an informed choice.

At the same time, to ensure that voters are not choosing among candidates with varying levels of criminal charges, the court has called on Parliament to frame a law binding political parties to not choose candidates who have been charged with a crime. A better solution is to institute fast-track cases for those who are in or seek public life. It would dissuade criminals from seeking elevation to legislators. Taken together, these measures will make it less attractive for political parties to opt for candidates who have been charge-sheeted. It can pave the way for better, more qualified persons opting for public office. Such a transformation is not impossible but requires political will and immense public pressure. The question is, does it exist?

स्वागतयोग्य फैसला

उच्चतम न्यायालय ने विशिष्ट पहचान प्रणाली ‘आधार’ की वैधानिकता पर बुधवार को अपना फैसला सुना दिया। संयुक्त प्रगतिशील गठबंधन (संप्रग) सरकार के समय आधार परियोजना शुरू होने के बाद से ही सरकार और निजी क्षेत्र दोनों ही पहचान के सहज तरीके के तौर पर आधार का इस्तेमाल करते रहे हैं। सरकार ने कल्याणकारी योजनाओं के अमल में गड़बड़ी रोकने में इसकी काबिलियत के चलते सार्वजनिक कोष के लिए इसे फायदेमंद होने का दावा किया है। लेकिन इसकी संवैधानिकता और इसके अतिशय इस्तेमाल को लेकर उठ रहे सवाल कायम रहे। खासकर निजता को मौलिक अधिकार बताने के उच्चतम न्यायालय के फैसले के बाद ये सवाल और भी मौजूं हो गए। लेकिन पांच न्यायाधीशों के पीठ के इस फैसले ने इस बहस पर फिलहाल विराम लगा दिया है। पीठ ने एक के मुकाबले चार के बहुमत से सुनाए फैसले में आधार अधिनियम को संवैधानिक बताया है लेकिन इसके इस्तेमाल पर कड़ी पाबंदियां भी लगाई हैं।

यह एक स्वागतयोग्य फैसला है। आधार को विशिष्ट पहचान सुनिश्चित करने के लिए लाया गया था लेकिन इसे स्वैच्छिक ही रखा गया था। हालांकि वक्त बीतने के साथ दूरसंचार कंपनियों, बैंकों और सरकारी कल्याणकारी योजनाओं जैसे तमाम निजी एवं सार्वजनिक क्षेत्रों में सेवा देने के लिए आधार को अनिवार्य बनाया जाने लगा। न्यायालय ने इस प्रवृत्ति को अस्वीकार्य बताते हुए कहा है कि आधार स्वैच्छिक ही होगा जिससे अलग होने का विकल्प भी होगा। आधार के जबरन इस्तेमाल को अदालत ने खारिज कर व्यक्तिगत स्वतंत्रता के पक्ष में आवाज बुलंद की है और इसके लिए वह तारीफ की हकदार है। उच्चतम न्यायालय ने आधार अधिनियम की धारा 57 को भी निरस्त कर दिया है जिसमें निजी कंपनियों को आधार के आंकड़े रखने की अनुमति दी गई थी। अब न तो कोई व्यक्ति या कोई कंपनी किसी से आधार मुहैया कराने की मांग कर सकेगी।

हालांकि न्यायालय ने कहा है कि सरकारी कल्याणकारी योजनाओं का लाभ लेने के लिए आधार अनिवार्य रहेगा। लेकिन उसने यह भी कहा है कि सत्यापन प्रक्रिया में नाकाम रहने पर उस व्यक्ति को लाभ से वंचित नहीं किया जा सकेगा। करदाताओं को भी अपने पैन कार्ड से आधार क्रमांक जोडऩा होगा। अब लोगों का ध्यान इस फैसले के क्रियान्वयन पर जाएगा। अब सरकार को यह सुनिश्चित करना होगा कि आधार का बेवजह इस्तेमाल रोका जाए। न्यायालय को भी अपने इस फैसले के अमल पर नजर रखनी होगी। अतीत में जब उच्चतम न्यायालय ने आधार से जुड़ी ऐसी गतिविधियों पर रोक लगाई थी तो सरकार ने उसकी अवज्ञा करते हुए आधार का इस्तेमाल और बढ़ा दिया था। इस फैसले के क्रियान्वयन से कुछ चिंताएं भी पैदा होती हैं। मसलन, वित्तीय तकनीक पर आधारित कंपनियों के लिए आधार पर आया फैसला प्रतिकूल हो सकता है। इसी तरह कल्याणकारी योजनाओं तक पहुंच के मामले में भी लाभार्थियों के चयन में भेदभाव एवं अपवाद के सवाल दोबारा खड़े हो सकते हैं।

संवैधानिक पीठ के इकलौते असहमत सदस्य न्यायमूर्ति डी वाई चंद्रचूड़ के विचार दूरगामी प्रभाव वाले हो सकते हैं। उन्होंने राज्यसभा में बहुमत से वंचित सरकार द्वारा आधार अधिनियम को पारित कराने के लिए इसे धन विधेयक के तौर पर पेश करने का तरीका अपनाने पर सख्त एतराज जताया। उन्होंने इसी आधार पर इस कानून को असंवैधानिक करार दिया है। संविधान निर्माताओं ने राज्यसभा को कराधान या सार्वजनिक व्यय से इतर कानूनों को रोकने का अधिकार दिया था। लेकिन न्यायालय ने कानून निर्माण में राज्यसभा को नजरअंदाज किए जाने को बहुमत से अपनी स्वीकृति दे दी है। भारतीयों के लिए यह चिंता का विषय होना चाहिए क्योंकि आगे चलकर लोकसभा में ही बहुमत रखने वाली सरकार के लिए ऐसा ही तरीका आजमाने का रास्ता खुल जाएगा।

तरक्की में आरक्षण का फैसला सरकारों के हवाल

सुप्रीम कोर्ट ने बिना किसी धमाके के अनुसूचित जाति और जनजाति को तरक्की में आरक्षण देने का रास्ता साफ कर दिया है। एक तरह से उसने सांप भी मार दिया और लाठी भी नहीं टूटने दी। अदालत ने २००६ में आए नागराज बनाम केंद्र सरकार के फैसले को बड़ी संवैधानिक पीठ के पास भी नहीं भेजा और उसमें से उन शर्तों को हटा दिया, जो नौकरियों में पदोन्नति के लिए आरक्षण दिए जाने के रास्ते में बाधा बन रही थीं। इन शर्तों के तहत सरकारों को ऐसा आरक्षण देने से पहले यह बताना जरूरी था कि नौकरी की विभिन्न श्रेणी में समाज के इस हिस्से का कितना प्रतिनिधित्व है। यह आंकड़ा भी मांगा गया था कि उससे कार्यक्षमता पर क्या प्रभाव पड़ेगा। नागराज के फैसले में सुप्रीम कोर्ट ने कहा था कि सरकारें तरक्की में आरक्षण देने के लिए बाध्य नहीं हैं। अगर उन्हें देना ही है तो इस तरह के परिमाणात्मक आंकड़े देने होंगे। सरकारें यह काम करना नहीं चाहती थींं।

साथ में अदालत यह भी जानना चाहती थी कि अभी भी इस वर्ग के कर्मचारियों के साथ सरकार में किस प्रकार का भेदभाव किया जाता है और कौन-सा कलंक है जो उन्हें आगे बढ़ने से रोकता है। हालांकि, मुख्य न्यायाधीश दीपक मिश्रा की पांच सदस्यीय पीठ ने फैसले में यह नहीं कहा है कि सरकार तरक्की में आरक्षण देने के लिए बाध्य है लेकिन ,उन्होंने उस पर कोई रोक भी नहीं लगाई है। यह फैसला चुनाव के इस वर्ष में राजनीति का जबरदस्त हथियार बनने जा रहा है। एक तरफ इस फैसले का सहारा लेकर सत्तारूढ़ दल अजा-जजा की नाराजगी दूर करने के लिए उन्हें आरक्षण देगा तो दूसरी ओर इससे नकारात्मक प्रभाव प्राप्त करने वाली जातियां गोलबंद होंगी। बसपा नेता मायावती ने फैसले का स्वागत किया है। जब केंद्र और राज्य सरकारें इस पर आदेश जारी करेंगी तो वे और भी आगे बढ़कर स्वागत करेंगी। इससे बसपा और सपा के बीच दूरी बढ़ सकती है। संभव है कि सत्तारूढ़ दल से दूर भागते अजा-जजा मतदाता उसके करीब आएं लेकिन, इस फैसले के विपरीत परिणामों से इनकार नहीं किया जा सकता। अजा-जजा उत्पीड़न निवारण अधिनियम में संशोधन के बाद समाज का गैर-दलित तबका नाराज है और तरक्की में आरक्षण के बाद वह और भी आहत होगा। इसलिए वोट बैंक की मौजूदा राजनीति में इस फैसले से समाज में न्याय और
सद्भाव के संतुलन कायम करने की चुनौती उपस्थित है।

आधार को मिली बुनियाद

हालांकि पांच सदस्यीय पीठ के एक जज ने आधार पर अपनी असहमति जताई, लेकिन उसका अकादमिक महत्व ही अधिक है।

आधार की वैधता पर सुप्रीम कोर्ट की मुहर केवल मोदी सरकार के लिए ही नहीं, उन सभी लोगों के लिए राहत की एक बड़ी खबर है जो सरकारी सेवाओं एवं अनुदान में पारदर्शिता के हामी थे और यह देख रहे थे कि इसका प्रयोग किस तरह अनियमितताओं को रोकने में सहायक बन रहा है। आधार पर सुप्रीम कोर्ट का फैसला इसलिए कहीं अधिक नीर-क्षीर भरा और संतुलित है कि एक ओर जहां उसने इस विशिष्ट पहचान पत्र के जरिये निजता का हनन होने के अंदेशे को निराधार बताया वहीं दूसरी ओर उन प्रावधानों को खारिज भी कर दिया जो आधार के अनावश्यक इस्तेमाल को बढ़ावा दे रहे थे। नि:संदेह इसका औचित्य समझना कठिन हो रहा था कि आखिर स्कूलों में दाखिले और परीक्षाओं आदि में आधार को अनिवार्य क्यों बनाया जा रहा है? इसी तरह निजी कंपनियों को आधार के आंकड़े एकत्र करने की अनुमति देने की भी जरूरत समझ नहीं आ रही थी।

सुप्रीम कोर्ट ने निजी कंपनियों को आधार का इस्तेमाल करने वाले कानूनी प्रावधान को रद करने के साथ ही आधार के विरोध में उतरे लोगों की ऐसी दलीलों को खारिज कर बिल्कुल सही किया कि यह पहचान पत्र लोगों की जासूसी का जरिया बन रहा है। दुर्भाग्य से इस तरह की दलीलें उस कांग्रेस के नेता भी दे रहे थे जिनकी पहल से आधार अस्तित्व में आया। यह अपनी तरह का विशिष्ट और विचित्र मामला ही कहा जाएगा कि जिस दल ने आधार को लागू किया वही राजनीतिक संकीर्णता के वशीभूत होकर उसके खिलाफ खड़ा हो गया। ऐसा करते हुए उसने यह देखना भी जरूरी नहीं समझा कि आधार के जनक कहे जाने वाले नंदन नीलेकणि क्या कह रहे हैैं? यह अच्छा हुआ कि सुप्रीम कोर्ट ने आधार को वैध बताने के साथ ही उससे संबंधित विधेयक को धन विधेयक के तौर पर पेश और पारित किए जाने को सही करार दिया।

यह हास्यास्पद है कि आधार के आलोचक और निंदक सुप्रीम कोर्ट के फैसले को सरकार के लिए झटका बताकर खुश हो रहे हैैं। स्पष्ट है कि वे यह देखने को तैयार नहीं कि सुप्रीम कोर्ट ने आधार को सही ठहराते हुए केवल उसके अनावश्यक इस्तेमाल को खारिज किया है। शायद वे इस तथ्य से भी अनभिज्ञ रहना चाहते हैैं कि सुप्रीम कोर्ट ने आयकर रिटर्न दाखिल करने के साथ ही पैन कार्ड को आधार से जोड़ने की व्यवस्था को हरी झंडी दिखाई है। यह सही है कि सुप्रीम कोर्ट ने बैैंक खातों को आधार से जोड़ने की सरकार की दलील नहीं मानी, लेकिन इसकी अनदेखी नहीं की जा सकती कि उसने यह नहीं कहा कि बैैंक खाताधारकों से पैन कार्ड की मांग नहीं कर सकते।

यह भी उल्लेखनीय है कि सुप्रीम कोर्ट ने आधार को जनहित में सहायक बताने के साथ ही गरीबों की ताकत कहा और यह भी स्पष्ट किया कि सब्सिडी देने वाली एवं जन कल्याणकारी योजनाओं में आधार लागू होगा। हालांकि पांच सदस्यीय पीठ के एक जज ने आधार पर अपनी असहमति जताई, लेकिन उसका अकादमिक महत्व ही अधिक है। सबसे महत्वपूर्ण तो यह है कि सुप्रीम कोर्ट ने आधार की बुनियाद को और मजबूत किया

योजना के स्वास्य की चिंता पहले

बीमारी से जूझना इस मुल्क में हर कोई अफोर्ड नहीं कर सकता। साधन-संपन्न ही ऐशो-आराम अफोर्ड कर सकते हैं, वो ही बीमारी भी अफोर्ड कर सकते हैं। नेशनल सैंपल सर्वे 2013-14 के आंकड़ों के हिसाब से इस मुल्क में होने वाली मौतों की करीब एक तिहाई मौतों से पहले कोई मेडिकल सहायता नहीं मिलती यानी वो मौतें बिना किसी चिकित्सकीय सहायता के हो जाती हैं। लाखों के इलाज की कीमत सुनकर गरीब आस बिल्कुल छोड़ देता है। आंकड़ों के मुताबिक देश में आर्थिक हैसियत के लिहाज से शीर्ष पांच प्रतिशत लोगों में से करीब 98 प्रतिशत लोगों को मरने से पहले कुछ-ना-कुछ मेडिकल सहायता मिलती है। करीब 39 प्रतिशत को कोई चिकित्सकीय सहायता नहीं मिलती।

देश में चिकित्सा की लागत का हाल यह है कि निम्न आय वर्ग तो वह कीमत सुनकर कांप ही जाता है, मध्यवर्गीय व्यक्ति के लिए भी चिकित्सकीय लागत बहुत जानलेवा साबित होती है। कोई गंभीर बीमारी का शिकार होने पर मध्यवर्गीय परिवारों में भी गहन आर्थिक संकट की नौबत आ जाती है। प्रेमचंद की कहानी ‘‘कफन’ में घर की गर्भवती बहू प्रसव-वेदना से मर जाती है, बिना किसी चिकित्सकीय सहायता के। मुल्क में आर्थिक तौर पर नीचे के पच्चीस प्रतिशत में से करीब 39 प्रतिशत की हालत बुधिया जैसी ही है, कोई चिकित्सकीय सहायता नहीं, दम टूट जाता है। गरीब परिवारों की गंभीर बीमारी की सूचना खौफ की तरह आती है, जिसमें घर-बार बिकने की आशंकाएं समाहित होती हैं। मोदी सरकार ने ऐसी स्थिति में योजना लांच की है-आयुष्मान भारत यानी प्रधानमंत्री जन आरोग्य योजना। इस स्कीम के तहत 10 करोड़ गरीब परिवारों का 5 लाख रु पये तक कैशलेस स्वास्य बीमा कराया जाएगा यानी करीब 50 करोड़ लोग इसके दायरे में आएंगे।

इस वित्तीय वर्ष यानी सितम्बर से मार्च, 2019 तक सरकार पर योजना के तहत 5000 करोड़ रुपये का खर्च बैठेगा। अगले साल जब यह योजना पूरे भारत में प्रभावी हो जाएगी तो यह खर्च 10 हजार करोड़ रुपये तक पहुंच जाएगा। इसमें से 60 फीसद हिस्सा केंद्र से मिलेगा, जबकि बाकी का 40 फीसद भार राज्य उठाएंगे। हालांकि कई राज्य सरकारों ने इस योजना में शामिल होने से इनकार कर दिया है। इसकी वजह राजनीतिक हैं। अगर पचास करोड़ लोगों को प्रभावित करने वाली आयुष्मान योजना के शुरुआती परिणाम सकारात्मक और संतोषजनक आए तो अगले लोक सभा चुनाव में यह भाजपा सरकार के लिए बड़ा मुद्दा होगा।

पचास करोड़ जनसंख्या का मतलब है कि मुल्क की आबादी का करीब चालीस फीसद हिस्सा योजना से लाभान्वित हो सकता है। यह संख्या बहुत बड़ी है, भाजपा आयुष्मान योजना के राजनीतिक लाभांश न ले जाए, यह स्वाभाविक चिंता भाजपा की हर प्रतिद्वंद्वी राजनीतिक पार्टी को होनी चाहिए और वह है भी। यह योजना विश्व की सबसे बड़ी स्वास्य योजना मानी जा सकती है। मोटे तौर पर योजना कुछ यूं काम करेगी कि इसका लाभ उठाने के पात्र परिवारों के पास कार्ड होगा। उस कार्ड को दिखाकर वह परिवार अपने बीमार सदस्यों का तय सरकारी या निजी अस्पतालों में इलाज करवा सकेंगे। उन्हें कोई भुगतान नहीं करना होगा। भुगतान की जिम्मेदारी सरकार की रहेगी।

शुरुआती रिपोटरे के मुताबिक करीब दस हजार अस्पताल इस योजना में शामिल हो चुके हैं। योजना निश्चय ही बहुत महत्त्वाकांक्षी है, परंतु इसमें चुनौतियां भी कम नहीं हैं। योजना में वित्तीय संसाधनों को लेकर चुनौती लगभग न के बराबर है। सरकार ने बजट 2018 में एक फीसद हेल्थ सेस को शामिल किया। इससे करीब 11000 करोड़ रु पये का अतिरिक्त फंड इकट्ठा होगा। सरकार इस पैसे का इस्तेमाल आयुष्मान भारत में करने की तैयारी में है। वित्तीय चुनौतियों से ज्यादा मारक चुनौतियां किसी योजना को जमीन पर उतारने में होती हैं। निजी क्षेत्र के अस्पतालों का ट्रैक रिकॉर्ड विपन्न तबकों को चिकित्सकीय मदद के मामले में खराब ही नहीं, अमानवीय रहा है। दिल्ली में तमाम निजी अस्पतालों को सरकार ने लगभग मुफ्त में जमीन उपलब्ध कराई थी, इस शर्त पर कि वहां गरीब तबकों का सस्ता इलाज होगा। पर बहुत मुश्किलें पेश आ रही हैं गरीबों के इलाज में।

कहना यह कि निजी क्षेत्र के लिए आयुष्मान योजना कमाई का माध्यम नहीं बनी तो पक्का है कि वह इसे बराये नाम भर कागज पर चलाए रखेगा। कोई ठोस उपलब्धि नहीं मिल पाएगी। जैसा कि संकेत मिल रहे हैं, निजी क्षेत्र की तरफ से आयुष्मान भारत योजना के कई रेटों पर असंतोष जताया जा रहा है। सिजेरियन ऑपरेशन का रेट आयुष्मान योजना में 9000 रुपये रखा गया। यानी कोई निजी अस्पताल सीजेरियन आपरेशन 9000 में करेगा पर कई निजी अस्पताल इस रेट को नाकाफी बता रहे हैं। तो कुल मिलाकर योजना जमीन पर कैसे उतरेगी, यह देखना महत्त्वपूर्ण है। इस तरह की रियायती योजनाएं सरकारी संस्थाओं के हवाले होती हैं, तो उनमें भ्रष्टाचार की राह खुलती है, और निजी संस्थाओं के हवाले हों तो ऐसी मुनाफाविहीन योजनाओं में उनकी दिलचस्पी नहीं होती। इसलिए घोषणाओं में कारगर और लाभप्रद दिखने वाली योजनाएं जमीन पर आते-आते घिसटती दिखती हैं। कई विपक्षी नेता योजना को पहले ही जुमला घोषित कर चुके हैं। तमाम राजनीतिक दल चाहेंगे कि योजना जमीन पर ना उतरे। देखने की बात यह भी कि योजना की सफलता में सिर्फ केंद्र सरकार की भूमिका नहीं रहेगी। राज्य सरकारों की भूमिका इसमें बहुत अहम है। आयुष्मान योजना के तहत पहला केस हरियाणा में आया जहां भाजपा की सरकार है। चिकित्सा में राज्य सरकारों के अस्पतालों की प्रमुख भूमिका रहने वाली है। उनकी गुणवत्ता और उनकी प्रतिबद्धता की खास भूमिका आयुष्मान में रहने वाली है। अगर भाजपा अपने ही शासित राज्यों में इसे कामयाबी से जमीन पर उतार पाने में कामयाब होती है, तो फिर गैर-भाजपा राज्यों पर एक नैतिक दबाव पड़ेगा और उससे उस राज्य की जनता का भी भला होगा।

इस मुल्क ने इतनी बड़ी बड़ी घोषणाएं देखी हैं कि जब तक कुछ ठोस परिणाम ना दिखाई दे, इस योजना के कंसेप्ट की तारीफ की जा सकती है। कार्यान्वन के विश्लेषण के लिए रुकना होगा। अगर इसका कार्यान्वन कामयाब हो गया तो फिर उनका काम बहुत मुश्किल हो जाएगा, जो पूछते हैं कि आखिर, मोदी से ठोस किया क्या है? यह योजना अपने आप में इतनी ठोस योजना है कि सिर्फ इसके सहारे ही चुनाव जीतने की महत्वाकांक्षा कोई राजनीतिक दल पाल सकता है। पर योजना के ही स्वास्य की चिंता पहले करनी होगी।

SC puts onus on executive to end criminalisation of politics, insists on disclosures to make voters aware of their candidates

On Tuesday, a five-judge bench of Supreme Court refused to disqualify candidates with criminal cases pending against them from contesting elections. However, the country’s political class would do well take to serious note of the bench’s lament that the “increasing trend of criminalisation of politics… strikes at the very root of democracy”. While showing a welcome inclination to not step out of its domain, the SC has asked Parliament to come up with a law to check the criminalisation of politics. It has also issued a slew of directives to ensure that the voters are aware of the antecedents of candidates. Political parties will have to upload details of criminal cases pending against their candidates on their websites. The candidates will have to furnish such information in their election affidavit and also publish it in a “widely-circulated newspaper”.

The Representation of the People Act (RPA) does not bar individuals who have criminal cases pending against them from contesting elections. It does state that an individual punished with a jail term of more than two years cannot stand in an election for six years after the jail term has ended. But the fact that cases drag on in courts for years makes this provision virtually ineffective. A 2014 report of the Law Commission, in fact, pointed out that “disqualification upon conviction has proved to be incapable of curbing the growing criminalisation of politics, owing to long delays in trials and rare convictions.” An affidavit submitted to the Supreme Court in March by the Centre also testifies to the shortcomings of the RPA’s disqualification clause. There are more than 3,800 criminal cases against 1,765 MPs and MLAs across the country, of which 3,045 cases are pending, the affidavit noted.

Notwithstanding the compelling urgency to decriminalise politics, the SC has always been steadfast that its interventions in the matter should not transgress the principles of separation of powers enshrined in the Constitution. At the same time, it has been unequivocal that “voters have a right to know about the candidates contesting elections”. In 2002, in Union of India Vs. Association for Democratic Reforms and Another, the court noted that such information should comprise, “antecedents of the candidate’s life including whether he was involved in a criminal case and if the case is decided”. The court’s ruling on Tuesday not only affirms such observations, it also underscores its dissatisfaction with the RP Act. “The time has come for a law against criminalisation of politics. The nation eagerly waits for such legislation,” the bench observed. The ball is now in the executive’s court.
