Wise Judgment on Judges

The judiciary and the executive have to maintain a fine balance. And for that reason, it was good—regardless of the way it happened—that Justice KM Joseph was eventually appointed to the Supreme Court. Any other outcome would have driven a wedge so deep that every other judiciary issue would have been marginalised. What’s important now is to refocus priorities, particularly as a rather tumultuous tenure of Chief Justice Dipak Misra draws to a close. Although his term ends on October 2, the transition process would begin by September. This may be a good time to make a fresh beginning through some basic judicial reforms.

For all those concerned with the state of lower judiciary and justice delivery, here’s a sobering number to consider: 5,436—the number of unfilled posts of judges, mostly at district levels in the lower judiciary across the country. Essentially, we have 17,109 judges against a total requirement of some 22,545 in the country. Which means we are roughly 25% short. It’s incumbent on the higher judiciary to take concrete steps to act on this shortfall soon. The usual riposte is: Even if these vacancies are filled, where are the courtrooms to cater for them?

True, India doesn’t yet have courtrooms for all 22,000 judges. But construction of courtrooms has been accelerated in the past few years. According law ministry numbers, there are 18,444 available courtrooms. This is more than the number of appointed judges. So, there’s no excuse to fill up the 5,000-plus vacancies. Because over the next two years, nearly 2,700 more courtrooms will be added. Why is there such delay in filling up this 25% deficit desperately needed to improve efficiency levels?

The problem is the absence of an objective benchmarking in selection standards. What’s also worrying is a clear mismatch between available resources and unfilled vacancies. The legal profession is attracting some of the best talent due to marked improvement in quality and expansion of legal education. Yet, there’s a huge deficit for the post of judges.

Set A Test

The usual refrain is that no one wants to become a district judge. Surely, it’s not the first port of call. Yet, there’s a glut at the supply end that must be tapped. Which is why an all-India examination for judges makes sense. The Supreme Court has gone silent on the subject after its amicus curiae Arvind Datar submitted his report in a PIL on the matter. What does a test do? It grades, sets a cut-off for interviews and then draws a shortlist after the process.

High courts are free to pick shortlisted candidates from their states, following the reservation norms applicable in their respective states. The call on whether this should eventually be turned into a judicial service is a conversation that can continue. But it makes sense to have a nationwide judges selection exam, both for filling up posts and benchmarking a basic judicial standard at the entry level.

Further, this is bound to have a salutary impact on the crop available for elevation to higher judiciary in the years ahead. One of the principal reasons for the quarrel over the alleged lack of credibility in the selection of judges to higher courts is not the collegium system, but the accusation of arbitrariness and discretionary latitude available to senior judges to appoint their subordinates.

Follow Up With Assessment

The exam is the first step towards establishing an objective benchmark, which must be followed up by an assessment and appraisal system like in every profession. This will also make it possible to institutionalise a mid-career screening process for elevation that can inform views on individual judges. A revamp in the selection process is also needed by the change in the nature of legal disputes. These now increasingly demand technical knowledge and sectoral specialists. This is why a cross section of legal talent needs to be recruited at the starting point itself.

Only recently, GoI cleared appointments of over 100 judges in one go. This is a significant number for high courts, perhaps the highest in recent times. But the scary part is there’s no way to know how one candidate gets selected over the other. It’s only when judges are considered for the Supreme Court that they come under any kind of serious public scrutiny. In short, there has to be an established objective basis for the selection and appraisal of judges. This is standard across professions, and the judiciary cannot be an exception harking back to an era where competence was established by word-of-mouth alone. Having said that, this shouldn’t become a cause for encroaching into the constitutional precinct of the judiciary. However radical the change may be, it must come from within the judiciary.

Faith must be reposed in the fact that the concept of an independent judiciary cannot possibly be in conflict with the legitimate opening of its guarded gates for new talent. Or for that matter, setting new benchmarks for selection and upward mobility. The judicial fraternity, of late, has been bruised by scathing battles, both within and outside its confines. It’s now an uneasy walk into what may appear a calmer space. But this interregnum provides an opportunity for the judicial leadership to rebuild credibility by embracing change, not by rejecting it.

Long live Indian healthcare

As the world changes, India faces a double burden of disease with new health threats. Disaggregating prevailing morbidity and mortality patterns exhibit our social gradients for health outcomes and the use of health systems. Ayushman Bharat seeks to address all of these. The world’s largest public health scheme is on the cusp of creating a paradigm shift in universal healthcare. It rests on two essential vectors: recognition that universal health insurance is essential for universal healthcare delivery. And that this can be fulfilled by subsuming ongoing government initiatives while making the Ayushman Bharat proposition portable across India. Much of this will rest on active collaboration with state governments and private healthcare.

  • Infrastructure Access: India has to build capacity as utilisation increases and also increase capacity utilisation of existing primary and community health centres. Meticulous implementation and robust healthcare delivery in these centres can reduce the need for secondary and tertiary care. Addressing problems associated with supply logistics and spurious medication is another challenge. Yet another question is participation from private sector. GoI must assure enough incentives to the private sector, which already faces problems of receivables and collection from government insurance schemes.
  • Skilled Professionals: Manpower optimisation practices, creation of skilled manpower including nurses, technicians and other support staff can increase resource efficiency for doctors. There are success stories from other developing countries. Costa Rica, for instance, established multiple integrated primary healthcare teams each looking after 5,000 people. These teams typically comprise paramedics who visit patients, an executive who maintains records, anurse, a pharmacist and a doctor. India’s system of aanganwadi and village healthcare workers like Asha Didi can be catalysts.
  • Quality: In India, the average duration of medical consultation is little more than two minutes. Not surprisingly, World Bank research has shown that only 30% of consultations result in correct diagnosis. While we have quality standards drafted by bodies such as the National Accreditation Board for Hospitals (Nabh), compliance is a different kettle of fish. And less than 1% hospitals have Nabh accreditation. Alarge-scale quality and patient experience audit, backed by implementation and interventions, is required to drive overall quality on multiple parameters. Infection control is especially important.
  • Patients: India must proactively evangelise patient education around health insurance. GoI should take the lead in facilitating public health, focusing on awareness and education. Increased penetration of both feature phones and smartphones is an opportunity. In Kenya, for example, M-Tiba is a dedicated health account on cellphones. It allows anyone to send, save and spend funds for medical treatment.

Relevance of technology and digitisation is imperative. GoI must invest strong emphasis on adoption of technology by the entire healthcare ecosystem. This adoption must provide accessible and affordable patient care to the last mile.

As Ayushman Bharat unfolds, an evidence-based strategy will have to address, and resolve, a slew of issues, many chronic. India needs preventive and/or promotive health: prevention, early detection and treatment. For instance, detection and treatment of diabetes at age 35 will avert kidney failure at age 50 if the condition remains undetected and untreated.

One must be careful of the following:

  • It must be mandatory for every National Health Protection Scheme (NHPS) beneficiary to register with a wellness and health centre. Medicines and diagnostics can be provided at subsidised prices or free to those who cannot afford it. Centres, manned by primary care physicians, can provide out-patient care, including diagnostic facilities and medicines. They can be filters for NHPS. Polyclinics with specialists and higher level of diagnostic facilities can be established for referrals from primary centres.
  • Ideally, all district hospitals should have equipment at par with private tertiary care hospitals. Further up the value chain, medical college hospitals should be equipped to be at par with private multi-superspecialty hospitals. These can be tweaked to demographics.
  • Admissions of any NHPS member to a hospital should be only on referral from the primary care centre or the specialist, except in emergencies such as accidents.
  • Empanelled hospitals should be graded according to their infrastructure available and quality of care provided. GoI should create a National Health Regulatory Authority (NHRA) replicated across states to bring in uniformity.
  • Ambulatory surgery centres can be very useful in lightening the load on hospitals. With an integrated approach we could see a healthier India. Success will depend upon focusing on health and not merely sickness.

ओबीसी आरक्षण का लाभ सिर्फ चुनिंदा जातियों ने ही उठाया है

अन्य पिछड़े वर्गो की जातियों के उपवर्गीकरण की संभावनाओं का पता लगाने के लिए गठित रोहिणी आयोग की ओर से मिले संकेत यदि यह रेखांकित कर रहे हैं कि ओबीसी आरक्षण का लाभ चुनिंदा जातियों ने उठाया है तो इसमें हैरानी नहीं। इस स्थिति को बयान करने वाले आंकड़े उपलब्ध भले न हों, लेकिन हर कोई यह जान रहा है कि हकीकत क्या है। यह विसंगति केवल ओबीसी आरक्षण तक ही सीमित नहीं है। यही हालत अनुसूचित जातियों एवं जनजातियों को मिले आरक्षण में भी है। अब जब ओबीसी आरक्षण में उपवर्गीकरण की दिशा में कदम उठाए जा रहे हैं तो यह जरूरी हो जाता है कि एससी-एसटी आरक्षण में भी ऐसा हो।

नीति-नियंता और राजनीतिक दल इससे अनभिज्ञ नहीं हो सकते कि यह आरक्षण में विसंगति अर्थात सभी पात्र जातियों को समुचित लाभ न मिल पाने का ही प्रतिफल है कि जहां ओबीसी की कुछ जातियां अनुसूचित जाति का दर्जा चाह रही हैं वहीं कुछ अनुसूचित जातियां जनजाति के रूप में अपनी गिनती कराना चाहती हैं। ओबीसी आरक्षण का अधिकतम लाभ उठाने वाली जातियां आमतौर पर वही हैं जो सामाजिक एवं आर्थिक रुप से अपेक्षाकृत सक्षम हैं। इन्हें पिछड़ों में अगड़े की संज्ञा दी जा सकती है। अलग-अलग राज्यों में पिछड़ों में अगड़े का दर्जा रखने वाली जातियां भिन्न-भिन्न हैं, लेकिन वे हैं सभी राज्यों में। इनमें से कुछ जातियां तो राजनीतिक रूप से भी प्रभावी हैं। इसके चलते उनका शासन में भी दबदबा है और कहीं-कहीं तो प्रशासन में भी।

इसका कोई मतलब नहीं कि सामाजिक, आर्थिक और राजनीतिक तौर पर प्रभावी जातियां आरक्षण का लाभ उठाती रहें। यदि समर्थ जातियों के लोग आरक्षण का लाभ लेते रहेंगे तो वे कहीं न कहीं अन्य ऐसी जातियों के अधिकारों का हरण ही करेंगे जो आरक्षण के दायरे में होने के बावजूद उसके न्यूनतम लाभ से वंचित हैं। समय आ गया है कि न केवल ओबीसी आरक्षण के तहत आने वाली जातियों का उपवर्गीकरण हो, बल्कि उन जातियों को आरक्षण के दायरे से अलग भी किया जाए जो अब आरक्षण का पात्र नहीं रह गई हैं। हालांकि क्रीमी लेयर की व्यवस्था इसी मकसद से की गई है, लेकिन उससे अभीष्ट की पूर्ति नहीं हो पा रही है। पता नहीं ऐसी कोई व्यवस्था एससी-एसटी आरक्षण में क्यों नहीं है? जैसे यह एक तथ्य है कि भारतीय समाज को समरस बनाने के लिए आरक्षण की आवश्यकता है वैसे ही यह भी कि इस व्यवस्था में कई विसंगतियां हैं।

आरक्षण का लाभ कुछ समर्थ जातियों के खाते में जाना केवल एक विसंगति है। अन्य विसंगतियों की चर्चा इसलिए नहीं होती, क्योंकि आरक्षण को राजनीतिक रूप से एक नाजुक मसला बना दिया गया है। परिणाम यह है कि कुछ ऐसी जातियां भी आरक्षण की मांग कर रही हैं जो इसके लिए पात्र नहीं हैं। विडंबना यह है कि वे आरक्षण की अपनी मांग मनवाने के लिए हिंसक तौर-तरीके भी अपना रही हैं। बेहतर हो कि ओबीसी जातियों के उपवर्गीकरण की दिशा में आगे बढ़ने के साथ ही आरक्षण की बढ़ती मांगों का भी कोई समाधान निकालने की कोशिश हो। यह कोशिश सामाजिक न्याय की अवधारणा के तहत ही होनी चाहिए।

आज का सच: दोस्ताना पूंजीवाद या अरबपति राज

राहुल गांधी शायद प्रधानमंत्री नरेंद्र मोदी के सामने सबसे मजबूत एवं यकीन दिलाने वाला विपक्षी चेहरा न हों, लेकिन राहुल ने वर्ष 2015 में मोदी पर ‘सूट बूट की सरकार’ के जरिये जो हमला बोला था उसने निश्चित रूप से सरकार को उद्वेलित किया। दोस्ताना पूंजीवाद को लोकोक्ति के तौर पर पेश करने वाली राहुल की यह शब्दावली गत जुलाई में पेश अविश्वास प्रस्ताव के दौरान टेलीविजन चर्चाओं में भी खूब चर्चा में रही। यह उदारीकरण के बाद भारत की राजनीतिक अर्थव्यवस्था के बारे में असुविधाजनक सच को भी बयां करता है। वह सच यह है कि आज भले ही लाइसेंस-राज खत्म हो चुका है लेकिन दोस्ताना पूंजीवाद जिंदा है। लाइसेंस एवं परमिट राज के दौरान फला-फूला सरकार और कारोबारी जगत का नाता थोड़े बदले रूप में अब भी कायम है।

निश्चित रूप से कुछ प्रतीक बदल गए हैं और उनके चेहरे भी अब अधिक युवा नजर आते हैं। मोदी भले ही चौकीदारी का दावा करते हों लेकिन 1991 के बाद बनी सभी सरकारें कमोबेश ऐसा दोस्ताना रवैया अपनाती रही हैं। वर्ष 1992 के एक नाटकीय संवाददाता सम्मेलन में सरकार पर उंगली उठाने वाले हर्षद मेहता को याद कीजिए। वर्ष 2000 के दशक के शुरुआती दौर में विनिवेश और दूरसंचार लाइसेंसिंग को लेकर फैली गड़बड़ी को याद कीजिए। इसी तरह संप्रग के दूसरे कार्यकाल में कोयला एवं दूरसंचार क्षेत्र में हुए घोटालों के बारे में सोचिए जिसने 2014 में संप्रग को लोकसभा चुनाव हारने की स्थिति में ला खड़ा किया। विजय माल्या की जमींदोज हो रही एयरलाइन पर बढ़ते कर्ज बोझ को भी जोड़ लीजिए। विमानन नीति में मददगार बदलावों का फायदा उठाते हुए ही माल्या इस स्थिति में पहुंचा था। ऐसे में मोदी आसानी से राहुल गांधी और उनकी पार्टी को यह जवाब दे सकते थे कि ‘अगर जूते फिट होते हों तो उन्हें पहन लेना चाहिए’।

अगर मौजूदा प्रधानमंत्री की मेहनत से बनी साफ छवि के बावजूद मौजूदा सरकार पर लगे आरोप टिके रहते हैं तो उसकी जड़ में आर्थिक सुधारों और कारोबारी सुगमता मानकों का नाकाफी होना ही है। ऐसा होने से भारतीय कंपनियां लगातार याचक की स्थिति में बनी रहती हैं (इसे लॉबीइंग के तौर पर भी जाना जाता है)। हमें यह ध्यान रखना होगा कि घोटालों की सबसे ज्यादा चपेट में आने वाले क्षेत्र वे हैं जो अब भी लाइसेंस प्रणाली या मूल्य नियंत्रण मानकों के तहत हैं। ऐसा नहीं है कि 1991 के बाद निजी क्षेत्र का विकास और विस्तार नहीं हुआ है। उदारीकरण के बाद से ही निजी क्षेत्र रोजगार पैदा करने वाला प्रमुख क्षेत्र रहा है और इस तरह राजनीतिक अर्थव्यवस्था में निजी क्षेत्र की भूमिका का जबरदस्त विस्तार हुआ है। सूचना प्रौद्योगिकी, ऑटोमोबाइल, होटल एवं आतिथ्य, रियल एस्टेट, स्वास्थ्य देखभाल, खुदरा, दूरसंचार, बैंकिंग और हाल में उभरा ई-कॉमर्स क्षेत्र उदारीकरण के बाद उभरे साहसी भारत के प्रतीक हैं।

इसी वजह से देश के वित्त मंत्री बजट पेश करने के बाद सबसे पहले सीआईआई, एसोचैम और फिक्की जैसे उद्योग संगठनों के परिचर्चा सत्रों में ही पहुंचते हैं। मोदी का अर्थव्यवस्था में उद्योगपतियों की अहमियत को रेखांकित करना सही है। इसी से शायद यह पता चलता है कि मोदी अपने विदेश दौरों पर कारोबारियों का प्रतिनिधिमंडल लेकर क्यों जाते हैं जबकि बहुत पहले ही उन्होंने गैर-सरकारी मीडिया को साथ ले जाना बंद कर दिया था। लेकिन बजट की कवायद आर्थिक गतिविधियों पर सरकारी वर्चस्व को रेखांकित करती है। कारोबारी समुदाय अब भी बजट का उसी बेसब्री से इंतजार करता है जैसा नब्बे के दशक से पहले करता था। हालांकि केवल कर प्रस्तावों के लिए ही नहीं बल्कि राजकोषीय घाटे के अनुमान और सरकार के उधारी कार्यक्रम पर उसके अंतर्निहित संकेतकों का अंदाजा लगाने के लिए बजट का इंतजार रहता है। नब्बे के दशक से पहले हमने बजट को कारोबारी समूहों के लिए शुल्क वृद्धि या कटौती से होने वाले लाभों की गणना के तौर पर सीखा था और आज भी वह कवायद जारी है।

आज यह सच है कि अमेरिका जैसी उन्नत अर्थव्यवस्थाओं में भी लॉबीइंग एक प्रमुख गतिविधि बन चुकी है। लेकिन राजनीतिक दलों को चंदा देने संबंधी सख्त प्रावधान होने और लॉबी करने वाले लोगों का बाकायदा पंजीकरण अनिवार्य होने से वहां पर काफी हद तक पारदर्शिता नजर आती है।  इसके उलट भारत में चंदा देने वाले के खुलासे से संबंधित कानून सख्त नहीं हैं। इस सरकार ने राजनीतिक चंदे के लिए आरबीआई के बॉन्ड जारी करने का जो प्रस्ताव रखा है वह इतना निकम्मा है कि उसे गंभीरता से नहीं लिया जा सकता है। बड़े सौदों को अंजाम दिलाने वाले फिक्सरों और मौकापरस्तों का अब भी रायसीना हिल पर बने मंत्रालयों में दखल कायम है और उनके निशाने पर केवल रक्षा सौदे ही नहीं होते हैं। नेताओं और कारोबारी समुदाय दोनों के लिए दोस्ताना पूंजीवाद पर आधारित व्यवस्था की सुंदरता इस मायने में है कि यह दोनों को ही खंडन की छूट देती है, भले ही इस साथ के असर सार्वजनिक रूप से नजर आते हों।

इसी से हमें पता चलता है कि यह संस्कृति क्यों फल-फूल रही है? लेकिन इसमें एक समस्या भी है: प्रश्रय देने वाला दोस्ताना जब तक किसी न किसी रूप में बना रहता है तब तक कारोबार का दायरा और आकार सिमटता जाएगा। भारत के कारोबारी जगत के ढांचे में हम इस पहलू को देख सकते हैं जहां परिवारों के नियंत्रण वाले चुनिंदा कारोबारी समूहों का ही दबदबा रहा है। ऐसे ताकतवर प्रतिद्वंद्वियों के होने से छोटे एवं मझोले क्षेत्र को टिके रहने के लिए जद्दोजहद करनी पड़ती है। स्थानीय स्तर पर फैला भ्रष्टाचार उनकी समस्या को और बढ़ाता है। भारतीय आर्थिक ढांचे के मौजूदा दौर को जेम्स क्रैबट्री ने ‘अरबपति राज’ की संज्ञा दी है। ‘अरबपति राज’ दोस्ताना पूंजीवाद से कहीं अधिक बेहतर तरीके से मौजूदा हालात को बयां करता है। यह अलग बात है कि इसके चलते लंबी अवधि में भारत को बहुत कुछ गंवाना पड़ेगा।
